Curiosity and intrigue about the American criminal justice system is a good thing.
The following pages hope to enlighten people about the facts and realities of our American criminal justice system from a Michigan perspective. Not the hype, rhetoric, and downright crazy things you see on A&E, CNBC, the Discovery Channel, FOX, MSNBC, National Geographic, TLC, truTV, or any other for-profit company spin on corrections. In fact, many of the defendants featured on COPS could presumable file lawsuits for the abuses experienced by those so-called law enforcement officers on COPS. The shamefulness of county prosecutors is readily understandable by visiting The Center for Public Integrity and checking out their HARMFUL ERROR: INVESTIGATING AMERICA'S LOCAL PROSECUTORS publication.
Our contemporary history is filled with judges whom have crossed the lines. Take, for example, UNITED STATES v DAVID W. LANIER, case No. 93-5608, decided 31 August 1994, and which is also published at 33 F3d 639 (6th Cir WD Tenn 1994). Go to http://www.ca6.uscourts.gov and look up Case No. 93-5608, FINDLAW to review the published cases, etc. There, you will see where TENNESSEE STATE JUDGE LANIER was convicted of seven (7) counts of willful deprivation of civil rights under color of law, based upon his conduct of sexually assaulting five women who were his employees, a worker in a juvenile program, or litigants before him. You will also see where the predator viciously fought to justify his misbehavior and ultimately fled like a coward, now being a fugitive, rather than surrendering himself to the United States Marshal. Hence, appeal of his conviction and sentence was dismissed. 123 F3d 945 (1997).
While the vast majority of those in our American criminal justice system try to do their jobs to the best of their ability, bad apples exist to poison the whole bushel. As with prisoners ourselves, everyone is only human and fallible. The more facts and realities people know about the criminal justice system, the more improvements can be made for the benefit of everyone now and for our posterity.
One thing to be mindful of is the astronomical costs involved to maintain our prison systems, and which begs to question whether the time (sentences or punishments) is commensurate to the nature of the crimes.
Just in Jami's case alone, since 1986, based on adjusted figures evident in the Corrections Budget (see, e.g., Michigan Public Act 345 of 2005), federal and state taxpayers have shelled out some $1.3 million to house Jami in prison for crimes involving $100 in cocaine and setting up gals and guys on dates in 1986-1987, and in 2000 for writing a letter to a legal state agency to help get another inmate a different appellate attorney so that he could obtain meaningful appellate review. Multiply Jami's case by the some 2,000,000 inmates in American prisons, and we wonder why are states are broke.
